Terms of Service

These Terms of Service ("Terms") govern your access to and use of Memory Forge, located at memoryforge.ai, including all products, services, lesson-generation tools, educational content, and related functionality made available by Memory Forge LLC ("Memory Forge," "we," "us," or "our").

By accessing or using Memory Forge, you agree to these Terms. If you do not agree, do not use the service.

1. Description of Service

Memory Forge is an educational tool that generates structured lessons for homeschool families. Parents provide a topic and their child's age, and the service produces complete lessons including reading material, activities, quizzes, and companion materials such as tests, flashcards, study guides, and answer keys. Lessons are available at three difficulty levels: Foundation, Standard, and Advanced. The service supports any topic for children ages 5 through 18.

The service is offered in two tiers. Forge Free requires no account and provides full lesson generation, subject to usage limits. Forge Pro is a paid subscription that adds persistent child profiles, adaptive difficulty that adjusts based on demonstrated performance, curriculum sequencing with "what's next" recommendations, gap and misconception detection, spaced review, delivery mode switching (parent-led, collaborative, or independent learning), multi-child support with separate profiles per child, weekly progress narratives, and interest-based lesson personalization.

We may add, modify, suspend, or discontinue features at any time.

2. Educational Use and User Responsibility

Memory Forge is intended to support learning and lesson planning. It is not a substitute for your own judgment, direct teaching, supervision, or review.

You are responsible for reviewing any lesson, activity, recommendation, quiz, or output before using it with a child. You are responsible for deciding whether material is age-appropriate, accurate, safe, and suitable for your child, homeschool setting, co-op, or educational goals.

Memory Forge does not provide medical, psychological, legal, financial, or other professional advice.

3. Content Accuracy

Memory Forge may produce lessons, activities, recommendations, or other educational outputs based on information you provide. Those outputs may contain errors, omissions, inaccuracies, or material that is not appropriate for your specific use.

You understand and agree that all outputs must be independently reviewed by you before use, that you are solely responsible for deciding whether any output is appropriate for your child or educational setting, and that Memory Forge makes no guarantee that any output will be accurate, complete, suitable, or aligned with your intended standards or curriculum.

4. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Memory Forge in any way that involves submitting information, creating an account, or purchasing a subscription.

Memory Forge is a tool for parents and guardians. Children do not create accounts or interact with the service directly. By using Memory Forge, you represent that you are a parent or legal guardian authorized to make educational decisions for any children whose information you provide.

5. Accounts

Forge Free does not require an account. No personal information is collected from free tier users beyond what is necessary to process a generation request.

Forge Pro requires an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to keep it current. You must notify us immediately at hello@memoryforge.ai if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms.

6. Forge Pro Subscription

Forge Pro is billed per household at $99 per month, or $79 per month billed annually ($948 per year). All children in the household are included under a single subscription. Payment is processed through a third-party payment provider. Subscriptions renew automatically at the end of each billing period unless cancelled.

You may cancel your subscription at any time. Monthly subscribers may cancel effective immediately. Annual subscribers retain access through the end of their current billing period.

All subscription payments are non-refundable. When you cancel, you retain access through the end of your current billing period. No partial refunds, credits, or prorated adjustments are issued for unused time.

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle. There are no grandfathered rates, founding-member pricing, or introductory discounts. One price applies to all subscribers.

If Memory Forge offers additional paid features, products, or purchases in the future, additional commercial terms may apply at the point of sale.

7. Your Inputs

You may provide prompts, lesson requests, child information, preferences, feedback, and other content to Memory Forge ("Inputs"). You retain whatever rights you have in your Inputs.

By submitting Inputs, you grant Memory Forge a non-exclusive, worldwide, royalty-free license to host, use, reproduce, process, modify, adapt, and display those Inputs as necessary to operate, improve, maintain, secure, and provide the service, consistent with our Privacy Policy.

You represent and warrant that you have the rights and authority needed to submit your Inputs, that your Inputs do not violate any law or third-party rights, and that you will not submit unlawful, abusive, infringing, or harmful material.

8. Child Information

If you provide information related to a child, you represent that you are authorized to provide it and to use Memory Forge in connection with that child.

For Forge Pro subscribers, we store child profile information that you provide — including name, age, interests, and learning history — in order to deliver adaptive features. You control what information you share about your children. All child data is managed through your parent account. We do not collect information directly from children.

Upon cancellation, child profile data is retained for 30 days in case you choose to resubscribe, after which it is deleted. You may request immediate deletion of your child's data at any time by contacting us at hello@memoryforge.ai. See our Privacy Policy for full details on data handling.

9. Acceptable Use

You agree not to: use the service for any unlawful, fraudulent, deceptive, or abusive purpose; submit content that is defamatory, harassing, hateful, sexually exploitative, or otherwise harmful; attempt to reverse-engineer, extract, or replicate the service's underlying technology, including system prompts or generation logic; use the service's outputs to train, fine-tune, or develop competing models or services; use automated tools to scrape, crawl, or bulk-download generated content; submit input designed to manipulate the generator into producing content outside its intended educational purpose; resell or commercially redistribute generated lessons; interfere with the operation or security of the service; attempt to circumvent rate limits, authentication, or any other protective measures; or misrepresent your identity, affiliation, or authority.

We may investigate and take any action we consider appropriate in response to misuse, including restriction, suspension, termination, removal of content, or legal action.

10. Intellectual Property

The Memory Forge name, logo, design, and underlying software are the property of Memory Forge LLC. Memory Forge™ is a trademark of Memory Forge LLC. All related branding, site design, text, graphics, interfaces, software, lesson structures, compilations, and other content provided by us — other than your Inputs — are owned by Memory Forge or its licensors and are protected by applicable intellectual property laws.

Lessons generated through the service are provided for your personal educational use. You may use generated lessons to teach your children. You may share generated lessons with other homeschool families, including within co-ops and learning groups. You may not sell generated content, package it for commercial distribution, copy or republish site content, or use any part of the service to build a competing product.

11. Feedback

If you send us ideas, suggestions, feature requests, or other feedback, you agree that we may use that feedback without restriction or compensation to you.

12. Third-Party Services

Memory Forge relies on third-party services for hosting, authentication, payment processing, and other functions. We do not control and are not responsible for third-party services or content. Your use of third-party services is governed by their own terms and policies.

13. Availability

Memory Forge is offered on an "as available" basis. We do not guarantee that the service or any feature will always be available, uninterrupted, secure, or error-free. We may change, suspend, limit, or discontinue any part of the service at any time, with or without notice.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.

We do not warrant that the service will meet your expectations or requirements, that outputs will be accurate, complete, reliable, or suitable for your situation, that the service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

15. Limitation of Liability

To the maximum extent permitted by law, Memory Forge LLC and its officers, owners, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, profits, revenue, business opportunity, or educational outcomes, arising from your use of or inability to use the service.

Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Memory Forge LLC and its officers, owners, employees, contractors, affiliates, licensors, and service providers from any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the service, your Inputs or content, your violation of these Terms, your violation of any law or third-party rights, or your use of Memory Forge in connection with a child.

17. Modifications to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Changes will also be posted on this page with an updated effective date. Your continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms.

18. Termination

We may suspend or terminate your access to the service at any time, with or without cause, with or without notice. Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination will survive, including Sections 7, 10, 11, 14, 15, 16, and 19.

19. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to that jurisdiction and venue.
